Terms of service
Effective November 7, 2026 · Version 1.1
These terms are an agreement between you and Amicalola Pros LLC, a South Dakota limited liability company ("Amicalola Pros", "AP", "we"). They cover amicalolapros.com, the homeowner request service, AP Leads, AP Receptionist, the AP Bundle, and every text, email and call that comes with them (together, the "Service").
Part A applies to everyone. Part B applies to homeowners. Part C applies to local businesses ("pros"). Part D applies to everyone.
Part A — For everyone
A1. Who we are
Amicalola Pros LLC connects homeowners who need a plumber or heating-and-cooling tech with independent local businesses, and sells those businesses a lead service and an AI phone receptionist. We are a connection and software service. We are not a contractor, and we do not perform, supervise, schedule, price, warrant or guarantee any work.
A2. Accepting these terms
You accept these terms when you submit a request, sign up as a pro, use a dashboard, or reply to one of our texts. If you do not agree, do not use the Service.
A3. Changes
We may change these terms. The current version and its date are always at the top of this page. For pros, a change that raises a price or reduces a credit takes effect at the start of your next 30-day period after we email you; continuing to use the Service after that is acceptance.
A4. Prior versions
This is version 1.1. Prior versions are listed at the bottom of this page with their effective dates and can be requested by email.
Part B — Homeowner terms
B1. The service is free for homeowners
Submitting a request costs nothing. We never charge a homeowner, ask a homeowner for a card, or take any payment between you and a pro.
B2. What we do and do not do
We send your request to up to 3 local businesses whose trade and service area match it. A business that accepts sees your name and phone and contacts you directly.
After that, the job is between you and the business. AP does not perform, mediate, refund or guarantee work. Price, schedule, quality, permits, warranties and any dispute about the work are between you and the business you hire. We do not verify every business's insurance or workmanship. Every business attests to us that it holds the license its state requires; check it yourself before work begins.
B3. Consent to be contacted
When you check the consent box on the request form you agree to the following wording exactly as shown there:
> I agree that Amicalola Pros LLC may text and call me at this number about my request, including with automated technology. Message and data rates may apply. Message frequency varies. Reply STOP to opt out or HELP for help. Consent is not a condition of any purchase.
We store that wording, the time you agreed and your IP address with your request. Full text-program details are in our Text message terms.
B4. Closing a request: DONE and STOP
- Reply DONE to any text about your request to close it. Businesses that have not accepted lose the ability to contact you through AP. A business that already accepted is told you closed it.
- Reply STOP to stop all texts from AP. STOP also closes your open request.
B5. Reporting a problem
Every confirmation text and the thank-you screen carry a report a problem link. No login is needed. Tell us what happened and add a photo if you like. We answer by email within 24 hours. Two reports about one business from different homeowners pause that business's listing while we review.
B6. Emergencies
If anyone is unsafe, call 911. If water is flooding, shut off the main water valve. AP Leads is a request service, not an emergency dispatch. Pros may not respond at once.
B7. Accurate information
Give us a real name, a phone you answer, and a true description. Requests that look like junk or come from outside our live counties are declined and nothing is sent.
Part C — Pro (local business) terms
C1. Eligibility and license attestation
You must be a business, or the owner or authorized agent of one, that performs plumbing or heating-and-cooling work in a US county we serve. By signing up you attest that:
- the business name, owner first name, phone, email and service area you give are true;
- the business holds every license its state, county or city requires for the trade you selected, the license number you give is that license, and it is current and in good standing;
- you will tell us within 7 days if a license lapses, is suspended or is revoked.
We may check your license against the state's public lookup, ask for a photo of the license card, and spot-check it at any time. A listing stays pending until the check clears. A false attestation is grounds for removal under C12.
C2. The three products
· Product · Price · Floor and terms ·
· --- · --- · --- ·
· AP Leads · $139 per 30-day period · Free in any period with fewer than 3 delivered leads. Founding members: fewer than 5, for their first three periods. Live counties only. ·
· AP Receptionist (standalone) · $149 per 30 days, including 500 minutes; $0.25 per minute over 500 · One-time setup fee by band: $49, $99 or $199 (see C6). Available nationwide. No floor. ·
· AP Bundle (Leads + Receptionist) · $239 per 30 days · Setup fee waived. The lead floor applies to the $90 lead portion only: a period with fewer than 3 delivered leads credits $90; the $149 receptionist portion bills regardless, because the line was on and answering. ·
All prices are in US dollars and exclude any tax we are required to collect.
C3. Card on file
A valid payment card saved through Stripe is required to list. We save it without charging it. No card, no listing. You authorize us to charge that card for the amounts in these terms on the dates in these terms, and to retry a failed charge. If the final retry fails, your listing pauses until the card is updated.
C4. AP Leads: when billing starts and how the floor works
- Billing starts the day your first lead is delivered. Nothing is charged before then. Your first 30-day period begins that day, and each period after runs 30 days from the last.
- A "delivered lead" is a homeowner request we sent to your number by text with an accept link. Delivered, not accepted: a lead you decline or ignore still counts. A lead the homeowner closed with DONE before you could accept does not count toward the floor or against you.
- The lead floor. At the end of each period we count the leads delivered to you in it. If the count is under 3, the period is free and no charge is made. If it is 3 or more, we charge $139. No claim is needed; the dashboard shows the running count and whether the period will bill.
- Founding members (the first 5 businesses per trade per county) have a floor of 5 for their first three periods, then 3. Founding members are also matched first on every lead for as long as they remain active and in good standing.
- Leads are not exclusive. Up to 3 businesses receive each request. We do not promise a number of leads, that any lead will answer, or that any lead becomes a job.
- Lead counter. Every delivered lead adds to your lifetime count. It drives the floor, your emails, and the receptionist setup-fee band.
C5. Disputes and credits
Each lead has a dispute button. These reasons earn an automatic credit: wrong number, outside your service area, duplicate, or no answer after two documented tries. Any other reason is reviewed by email within 24 hours.
- A credit is a flat $15 off your next charge.
- Credits are capped at $75 in any one period.
- A credited lead is removed from that period's floor count, so a bad lead cannot turn a free period into a billed one.
- A lead the homeowner closed with DONE before you could accept is not a delivered lead (C4.2): it is not counted toward your period, so there is nothing to credit and nothing to dispute.
- A credit is applied to a future charge. It is a liability on our books until applied; it is never paid in cash. Unapplied credits expire when your account closes.
- Disputing a lead you in fact called and quoted, or disputing in a pattern we judge abusive, is grounds for removal under C12.
C6. AP Receptionist
- What it is. An AI assistant on a phone number we provide, answering in your business's name, collecting the caller's problem, address, urgency, name and callback number, texting you a summary, and transferring true emergencies to the cell you give us. Every call opens with a disclosure that the caller is speaking with an AI assistant. You must not ask us to remove that disclosure. See our AI disclosure.
- Price. $149 per 30 days including 500 minutes of call time. Minutes over 500 in a period are billed at $0.25 per minute on the next charge. The receptionist runs on its own 30-day cycle from the day it is switched on, unless bundled (C7). No lead floor applies to the receptionist.
- Setup fee. A one-time setup fee is charged when the receptionist is added, set by your lead counter at that moment: band 0 (no leads yet) $49 · band 1 (1–9 leads) $99 · band 2 (10 or more leads) $199. The setup fee is non-refundable once paid, including on cancellation or removal. It is waived for the Bundle.
- Forwarding is yours to set up. The receptionist only answers calls your carrier forwards to it. We give you the instructions and a test call; the dashboard shows "Not forwarding yet" until the test passes. Charges run from the day the receptionist is switched on, whether or not you complete forwarding.
- Recordings and transcripts. Calls to your receptionist number are recorded and transcribed to produce your summary and call log. You are responsible for any notice your state requires for calls to your business line; the AI disclosure at the start of each call includes a recording notice.
- Your number. The receptionist number is ours, assigned to you while the service is active, and released 30 days after the service ends.
- Not for emergencies in place of 911. The receptionist tells callers who are in danger to call 911. It is not a life-safety or alarm service.
- Minutes and uptime. We aim for the receptionist to answer every forwarded call but do not guarantee uptime, call quality, or that every caller's details are captured correctly.
C7. AP Bundle
The Bundle is AP Leads and AP Receptionist together for $239 per 30 days, setup fee waived. One 30-day cycle runs from the day the receptionist is verified or the first lead lands, whichever comes first. The lead floor applies to the $90 lead portion only: a period with fewer than 3 delivered leads (5 for founding members in their first three periods) credits $90 and you pay $149. A standalone receptionist customer who adds leads converts to the Bundle at the Bundle price; a setup fee already paid is not refunded. A Leads customer who adds the receptionist keeps the lead cycle and the receptionist starts the same day, prorated for the first period.
C8. Referral credit
Every paying pro may share one referral link. When a business you refer signs up through your link and completes a paid period, you receive one free period of your lead service (or a $90 credit on the Bundle's lead portion) on your next charge. One referral credit per referred business. Referral credits are credits under C5 (never cash), do not count toward the $75 dispute cap, and are void if either business is removed under C12. We may change or end the referral program for future referrals at any time.
C9. Cancellation
- One click, from the Billing screen or any billing email. No call, no reason.
- Your listing and receptionist run to the end of the current 30-day period, then stop. There is no partial-period refund. Leads keep flowing until the period ends, and you can un-cancel from the Billing screen before then.
- Minute overage used before the end date is billed on the final charge.
- Credits not yet applied at the end date expire.
C10. Rejoining
A business that cancels and later returns is matched by business phone, Stripe customer and license number. It rejoins on the standard floor (3), not the founding floor, and its lead counter carries over. There is no waiting period.
C11. Pausing
You may pause leads from the dashboard (for example, on vacation). A paused period in which fewer than 3 leads were delivered is free under C4. The receptionist cannot be paused separately; cancel it under C9 if you no longer want it.
C12. Removal by Amicalola Pros
We may pause or remove any pro at any time, at our sole discretion, with no refund of fees paid. Grounds include, without limitation:
- false or unverifiable license or business information;
- impersonating another business or person;
- fraudulent or abusive dispute claims;
- a chargeback on any AP charge;
- unlicensed work where a license is required;
- repeated homeowner reports, including the automatic pause after two reports from different homeowners;
- failing to respond to leads in a way that harms homeowners;
- any unlawful conduct, or conduct we judge harmful to homeowners, other pros or AP.
Removal is a status change. You receive one email stating the listing has been closed. A removed business, its owner, and any successor business of the same owner may not sign up again.
C13. How you may use leads
A lead's name, phone and address are for contacting that homeowner about that request. You may not sell, share, resell or add a lead to a marketing list, or contact a homeowner about anything else without the homeowner's own consent. You must honor a homeowner's request not to be contacted. You are responsible for your own compliance with telemarketing and texting laws when you contact a homeowner.
C14. Consent to texts and calls from AP
By signing up you agree to the Amicalola Pros Alerts program described in our Text message terms: lead alerts, follow-ups, billing and account notices, receptionist summaries and login codes, by text to the mobile number you verify, including with automated technology. Message and data rates may apply; frequency varies; reply STOP to opt out. Because lead alerts are texts, replying STOP means you receive no leads until you reply START or re-enable texts in the dashboard; your billing period and floor continue to run.
C15. Your account
Login is by a one-time text code to your verified mobile. Keep that phone secure. You are responsible for everything done from your dashboard. Tell us at once if your number changes or your phone is lost.
C16. Taxes
Prices exclude sales, use or similar taxes. Where a state requires us to collect tax on our service, we add it to the charge and show it on your receipt.
C17. Assignment to a successor
We may assign these terms, your subscription, your lead history and the related data to a successor that acquires Amicalola Pros LLC or substantially all of its assets, without your further consent. Your terms do not change on assignment unless the successor notifies you under A3. You may not assign your account to another business.
Part D — Legal terms for everyone
D1. Our content and software
The site, the dashboards, the receptionist agents, the text templates and everything else we publish are owned by Amicalola Pros LLC or its licensors. You may use them only as these terms allow. You keep ownership of information you give us and grant us a license to use it to run the Service.
D2. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty about the number, quality or outcome of leads, the conduct of any pro or homeowner, or the accuracy of any AI-generated summary or transcript.
D3. Limitation of liability
To the fullest extent the law allows, Amicalola Pros LLC and its members, managers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost jobs, lost data or lost business, however caused. Our total liability to you for all claims arising from the Service in any 12-month period is limited to the greater of (a) the fees you paid us in that period and (b) $100. Some states do not allow some of these limits; in those states our liability is limited to the smallest amount the law permits.
D4. Indemnity (pros)
A pro will defend and indemnify Amicalola Pros LLC against any claim, loss or expense (including reasonable attorneys' fees) arising from the pro's work, the pro's contact with any homeowner, a false attestation under C1, or the pro's breach of these terms or of any law.
D5. Dispute resolution and arbitration
Please read this section. It affects your rights.
- Talk to us first. Email hello@amicalolapros.com with "Dispute" in the subject. We will try to resolve it within 30 days.
- Binding arbitration. If we cannot, any dispute between you and Amicalola Pros LLC arising from the Service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or Commercial Rules for pros), by one arbitrator, by video or document submission unless a hearing in person is required, in which case it is held in Sioux Falls, South Dakota. The Federal Arbitration Act governs this section.
- Small claims. Either side may instead bring an individual claim in small-claims court if it qualifies.
- No class actions. Claims are brought individually only. No class, collective or representative action, and no arbitrator may consolidate claims of different parties.
- Opt out. You may opt out of arbitration by emailing hello@amicalolapros.com within 30 days of first accepting these terms, with your name, phone and the words "Opt out of arbitration". Everything else in these terms still applies.
- Injunctions. Either side may seek an injunction in court to protect intellectual property or to stop misuse of homeowner data.
D6. Governing law and venue
These terms are governed by the laws of the State of South Dakota and applicable US federal law, without regard to conflict-of-law rules. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts in Minnehaha County, South Dakota, except that a homeowner may bring a qualifying small-claims action in their home county.
D7. Notices
Notices to you go to the email or mobile number on your account. Notices to us go to hello@amicalolapros.com or by mail to:
Amicalola Pros LLC c/o Registered Agent 3916 N Potsdam Ave PMB 5859 Sioux Falls, SD 57104
D8. General
If any part of these terms is unenforceable, the rest stands. Our failure to enforce a term is not a waiver. These terms, the Privacy policy, the Text message terms and the AI disclosure are the whole agreement between you and us about the Service. Headings are for reading only. "Including" means "including without limitation".
